Terms and conditions for ATFS’s new Applicants 1. The Distributor is required to thoroughly read and understand the term and conditions, policies, procedures, code of conduct of the company. This application/agreement form is a legally binding document. 2. Kindly note that the name, as written in the application, will appear in all company records & other relevant company related communications, including the cheque. 3. The applicant should be of minimum 18 years of age and shall be competent to enter into a contract as provided in the ‘Indian Contract Act’. 4. In order to complete the joining formalities one is required to fill the application form of the company and pay the required fees in cash or DD in favor of ‘ATFS Multiservices Pvt. Ltd.’ For insurance policies the DD should be made in favor of the insurance company. 5. No Distributor shall become a member of any other Network Marketing Company directly & indirectly or have any financial interest in them. One has to resign from ATFS If he/she desires to join any other Network Marketing Company. Similarly if an active member of any other Network Marketing Company wants to become a Distributor of ‘ATFS Multiservices Pvt. Ltd.’ He has to resign from his previous company. 6. If an ATFS distributor is found to be involved in any other Network Marketing Company, ATFS shall terminate his/her distributorship with immediate effect and no payment will be made henceforth. 7. Once a Distributor is terminated, he/she cannot enter any of the ATFS premises/meeting locations and his/her incentives/income will be suspended immediately. 8. Upon cancellation of one’s distributorship he/she will not be allowed to use the logos and symbols of the company and the pins and badges, awarded by the company. 9. Confirmation of one’s distributorship does not create any employer/employee relationship, partnership or a joint venture between the Distributor and the company. 10. The Distributor will not have any right/authority to incur any debt/liabilities/obligations for and on behalf of the company. 11. Without the proof of the receipt of transaction, ATFS will not be responsible for any type of payment transaction done by you with anybody. 12. The Distributor shall bear true allegiance to the company and uphold its values and ideals while maintaining good relationship with other distributors and clients.. 13. The company will not be answerable for any commitment made by any distributor to any person, unless it is in accordance with the approved business plans and terms of the company. The company shall not be responsible for any delays or failure in performance due to unforeseen circumstances beyond either party’s control, which includes strikes, riots, labor difficulties, war, fire, death, curtailment of party’s usual sources of supply or government orders. 15. As per the Income Tax Act 1961, T.D.S. will be deducted from the commission vouchers issued to distributors at the rate applicable at that time. 16. The company reserves the right to modify the terms and conditions, products, rewards, business model without any prior notice and it will be binding on all distributors of the company. 17. If any dispute or difference arises between the Distributor & the company in relation to the business or interpretation of any terms and conditions or as to incentives, income etc., the same shall be referred to arbitration and the arbitration shall be governed by the ‘Arbitration And Conciliation Act, 1996’. The arbitration shall be subject only to Lucknow jurisdiction.
